Refund and Cancellation Policy

This Refund and Cancellation Policy applies to all online courses, digital educational content, subscriptions, memberships and related digital products made available through uscmarketplace.com by USC Market Place PTY LTD, ABN 93 182 464 ("we", "us" or "our").

Payments made through our website are processed by Braintree, which acts as the Merchant of Record for these transactions.

1. 14-Day Refund Policy

Unless otherwise stated at the time of purchase, customers may request a full refund within fourteen (14) calendar days from the date of the original purchase.

A refund request must be submitted within the 14-day period using one of the following methods:

  • through the "View Receipt" or "Manage Subscription" link contained in the purchase confirmation email;
  • through Braintree's buyer support portal;
  • by contacting us at support@uscmarketplace.com.

Where a refund request is approved, access to the relevant course, subscription, membership or digital content may be suspended or terminated.

2. Digital Course Access

Our courses and educational products are supplied digitally and may become available immediately after payment.

Customers are encouraged to review the course description, curriculum, access period, technical requirements and other relevant product information before completing a purchase.

Our 14-day refund policy applies from the original purchase date, subject to applicable law and the provisions of this Policy.

We reserve the right to refuse a refund request where there is evidence of fraud, misuse, abuse of the refund process or repeated purchases and refund requests made for the purpose of accessing substantial portions of our content without payment.

This provision does not limit any non-excludable rights available under applicable consumer protection law.

3. Subscriptions and Memberships

Where a product is supplied as a recurring subscription or membership:

  • customers may request a refund of the initial subscription payment within fourteen (14) calendar days of the initial purchase;
  • customers may cancel their subscription at any time to prevent future recurring charges;
  • cancellation takes effect at the end of the current paid billing period unless otherwise stated;
  • cancelling a subscription does not automatically generate a refund for payments already processed;
  • renewal payments are generally non-refundable, except where required by law, where a duplicate or incorrect payment has occurred, or where we or Braintree approve the refund in exceptional circumstances.

Customers remain responsible for cancelling their subscription before the next billing date if they do not wish the subscription to renew.

4. Technical Problems and Inability to Access a Course

Customers experiencing technical problems should contact us at support@uscmarketplace.com and provide:

  • the email address used for the purchase;
  • the name of the course or product;
  • a description of the issue;
  • screenshots or other relevant information, where available.

We will make reasonable efforts to resolve technical problems promptly.

A refund, replacement access or another appropriate remedy may be provided where:

  • a material technical issue prevents access to the purchased course or product;
  • the issue cannot be resolved within a reasonable period;
  • the product is materially different from its advertised description;
  • the purchased content was not supplied;
  • the service does not meet applicable consumer guarantees.

Minor or temporary technical issues that can be corrected within a reasonable period will normally be resolved by providing technical assistance or restoring access.

5. Australian Consumer Law

Our courses, digital products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in this Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where a course, product or service has a major failure, an Australian consumer may be entitled to cancel the service and receive a refund for the unused portion, or to receive compensation for any reduction in value.

Where a failure is minor, we may first be entitled to correct the issue within a reasonable period.

A customer is not automatically entitled to a refund under the Australian Consumer Law solely because they:

  • changed their mind;
  • no longer require the course;
  • did not complete the course;
  • failed to use their account;
  • found an alternative course or a lower price elsewhere;
  • did not achieve a particular personal, professional, academic or financial result, unless that result was expressly guaranteed by us.

However, our voluntary 14-day refund policy may provide additional rights beyond the minimum rights available under the Australian Consumer Law.

6. Course Results and Educational Outcomes

Unless expressly stated in writing, purchasing or completing a course does not guarantee:

  • employment or promotion;
  • admission to an educational institution;
  • passing an examination;
  • obtaining a licence, certification or professional registration;
  • immigration, visa or residency approval;
  • a particular income, business result or financial outcome.

Refunds will not ordinarily be provided solely because a customer did not achieve a desired outcome, provided that the course was supplied as described and in accordance with applicable consumer guarantees.

7. Duplicate or Unauthorised Transactions

Customers who believe that they have been charged more than once, charged an incorrect amount or charged without authorisation should contact Braintree or notify us immediately at support@uscmarketplace.com.

We and Braintree may request information reasonably necessary to investigate the transaction.

Confirmed duplicate or incorrect charges will be refunded to the original payment method.

8. Refund Processing

Approved refunds will normally be returned to the original payment method used for the purchase.

Refunds are processed by Braintree. After approval, the time required for the funds to appear in the customer's account may depend on the customer's bank, card issuer, payment method and location.

Where possible, approved refunds will be processed within fourteen (14) days of approval.

Currency conversion charges, exchange-rate differences or fees imposed independently by a customer's bank or card issuer are outside our control.

9. Chargebacks and Payment Disputes

Customers are encouraged to contact us or Braintree before initiating a chargeback or payment dispute so that we have an opportunity to investigate and resolve the issue.

Submitting a fraudulent, dishonest or abusive chargeback may result in suspension or termination of access to our courses and services.

Nothing in this section prevents a customer from exercising any lawful right to dispute an unauthorised or incorrect transaction.

10. How to Request a Refund

To request a refund, customers may:

  • use the refund or support link included in their Braintree transaction receipt;
  • access the "Manage Subscription" or "View Receipt" link in their confirmation email;
  • submit a request through Braintree's buyer support portal; or

Refund requests should include the customer's name, purchase email address, course or product name, transaction details and the reason for the request.

11. Changes to This Policy

We may update this Policy from time to time to reflect changes to our products, business practices, payment arrangements or applicable laws.

The version of the Policy in effect on the original purchase date will generally apply to that purchase, unless a later version provides greater rights or applicable law requires otherwise.
